It appears Festiva Resorts is again resorting to intimidation and coercion by Registered Mail to many of the litigant owners at the Atrium. Today letters were received demanding the sum in the amount of $426 with no accounting of where this amount comes from. It gives the owner 30 days to pay this amount or the membership in the Atrium Resorts will be cancelled. The owners that have received this notice also received notices in June with different amounts, at that time the Festiva representative agreed that the amounts were in dispute as the owners did have agreememts in place that were issued through the SXM court system and Atrium attorney Veen. Festiva has continually in the past two years tried to violate these agreements and we are presently in court defending the terms and conditions of our lease agreement. Even so Festiva continues to send demand letters for monies not due as per our lease agreements and written agreements with the litigants. Any Atrium owner not party to the litigation please contact me as you can still join the "Atrium Resort Leaseholders Organization" and be involved in protecting you leaseholder rights. Festiva Resorts is trying through the court system to change the reference in our lease agreements to the CPI of the NA as the index to raise our maintenance fees each year. They propose to just do away with any reference to any index and only use the actual projected budget amoounts to raise our maintenance fees each year. If this suit is won by Festiva Resorts it will affect each and every timeshare agreement in SXM that use any index as a reference to raise any maintenance fees. Please contact me at
